The Canadian Anti-Spam Legislation (CASL) is about to make its presence felt. The portion of the Act that governs the sending of commercial electronic messages (e-mails, social networking, and text messages to cellular phones) comes into effect on July 1, 2014. The portion of the Act that governs the unsolicited installation of computer programs or software comes into effect on January 1, 2015.

The implication of the Act is that all Individuals, corporations and non-corporations sending commercial electronic messages will first have to obtain specific consent from the recipient - written or oral, express or implied, before transmitting any electronic message. There will also be the requirement for an "Unsubscribe" option on all electronic messages sent after July 1, 2014.

Failing to comply to this new legislation will expose individuals / corporations to significant fines - $1,000,000 and $10,000,000 respectively and directors, officers of corporations can also be liable, if they directed, authorized or participated in any way in the violation of the Act.
